Cosmetics policy

Listings for cosmetic products must comply with the UK’s Cosmetics Regulation (for sales in England, Scotland and Wales) and the EU’s Cosmetics Regulation (for sales in Northern Ireland) and be safe for human health. 

Listings for used cosmetics, sponges or applicators are not allowed. Used cosmetics present health and safety concerns because the products and applicators used to apply them often come into direct contact with the body. This is why we generally don't allow them to be sold on eBay.

What is the policy?

  • Cosmetic products must be fully compliant with the applicable laws, including being notified to the Office for Product Safety Standards (OPSS) using the Submit Cosmetic Product Notification (SCPN) service - opens in new window or tab for sales in Great Britain and notified to the European Commission using the Cosmetic Product Notification Portal (CPNP) - opens in new window or tab for sales in Northern Ireland
  • Sellers must include the following information in the listing:
    • The responsible person of the cosmetic product with a UK established address and/or Northern Ireland or EEA address depending on where the product is being sold
    • The name of the cosmetic product, the list of ingredients and the EAN number
  • Listings cannot make any illegal or false claims including, but not limited to, cosmetic claims
  • All cosmetic products must come in the original container
  • Only permitted business sellers are allowed to sell cosmetic products containing CBD. CBD cosmetics are allowed only if they comply with all applicable legal requirements, including but not limited to:
    • The product is notified to the OPSS and to the EU Commission as noted above
    • The listing includes the required information (responsible person and all product details) as outlined above
    • The product is safe and complies with all applicable legal requirements
    • The product and the listing do not include any claims that could be illegal or violate other applicable regulations
    • The product complies with the Illegal drugs and drug paraphernalia policy
    • The product is listed in only the dedicated Health & Beauty > Natural & Alternative Remedies > CBD Products category
    • The product is shipped in only the UK (England, Scotland, Wales and Northern Ireland)
  • Listings for used cosmetics, sponges, or applicators are not allowed. This includes products such as skin moisturisers, sunscreens, perfumes, lipsticks, fingernail polishes, eye and facial makeup preparations, shampoos, permanent waves, hair colours, toothpastes, and deodorants
  • Used cosmetic brushes can be sold but must be thoroughly cleaned
  • Homemade cosmetics must comply with government regulations

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.

Why does eBay have this policy?

We require sellers to follow all federal and state laws and regulations when listing on eBay. Because the sale of used cosmetics may be regulated or prohibited by law, or may cause harm to eBay or its members, we don't allow sellers to list these items.
