eBay and Nectar

Nectar, the UK's largest loyalty programme, has made arrangements with eBay to offer eBay buyers the opportunity to collect Nectar points on eligible items and then convert them to an e-voucher to spend them on items that are purchased on eBay.co.uk.

The below terms apply to all eBay users who choose to participate in Nectar on eBay.

1. Collecting Nectar points

To begin collecting Nectar points with eBay you must have a Nectar card. If you don't already have one, just go here - opens in new window or tab and click on Join Nectar. You must be a UK resident to register for a Nectar card and take part in the Nectar programme.

You must have an eBay.co.uk account, a Nectar account and link the two together. You can then collect Nectar points every time you buy eligible items on eBay.co.uk where the Nectar logo is displayed on the view item page and you check out using a credit card, debit card, PayPal, or PayPal Credit.

You will not collect Nectar points on any transactions that occurred before you linked your eBay.co.uk and Nectar accounts.

You will receive one Nectar point per £1 you spend per item up to a maximum of 300 Nectar points. If you spend £xx.99, this will be rounded up for the purposes of collecting Nectar points. Anything less will be rounded down. As an example – if you spend £29.99, you will receive 30 Nectar points. If you spend £29.95, you will receive 29 Nectar points.

Please note that points are generally calculated per item not on the total purchase price. For example, if you purchase 3 items in a single transaction worth £4.95 each, you will receive 4 Nectar points for each item for a total of 12 Nectar points.

However, if you buy multiple quantities of the same item from the same seller, the points for those items will be calculated based on the total price. For example if you buy 2 of the same item from the same seller for £5.99 each , the points will be calculated based on a total price of £11.98, and you will receive 11 points.

Nectar points are calculated according to the actual amount spent on the item. Any amount spent on postage & packaging or any taxes not included in the item price will not be taken into consideration.

If items are bought from sellers outside the UK, payment may be subject to a conversion rate. The amount of Nectar points you can collect on such transactions will depend upon the final purchase price paid using a credit card, debit card, PayPal or PayPal Credit (except any amount spent on postage & packaging or any taxes not included in the item price).Collected Nectar points will be credited to your Nectar account within 28 days of paying for an eligible item.

1.1 Refunds

If you receive a refund for any reason on the purchased items, the awarded Nectar points will be deducted from your Nectar account within 28 days of the refund. Points deductions for refunds of multiple items are calculated on the individual item price.

1.2 Bonus offers

From time to time you may see bonus points displayed on the view item page. This means that you are eligible for a Nectar bonus offer. The bonus points displayed on the view item page are accurate for the respective item only and will be subject to time restrictions.

You will collect the Nectar points and any bonus points when you checkout with a credit card, debit card, PayPal or PayPal Credit using your linked eBay.co.uk and Nectar accounts.

You can collect up to 300 Nectar points per item. This limit also applies to bonus points promotions but is increased in line with the promotion. For example – if you purchase an item for £500.00 (collecting a maximum of 300 base Nectar points) and have a bonus points offer enabling you to collect double Nectar points, you will collect 600 Nectar points in total.

There is no cash alternative and the offer is not transferable. Points are awarded to the linked Nectar account within 28 days from the date the item is purchased.

eBay reserves the right to change or cancel any bonus offer promotions at any time, if in eBay's opinion it is necessary for it to do so.

eBay's decision is final in all cases and no communication will be entered into.

1.3 Exclusions

All items purchased in the following categories are not eligible for Nectar points on eBay.co.uk:

1. Cars, Motorcycles and Vehicles - opens in new window or tab (Parts and accessories are NOT excluded)
2. Holidays & Travel - opens in new window or tab
3. Property - opens in new window or tab
4. Gift Vouchers, Coupons, Coins & Bullion
5. Baby Feeding: Formula - opens in new window or tab

Items sold by the following sellers are not eligible for Nectar points on eBay.co.uk:

1. Tesco outlet
2. Co-operative Electrical
3. Telephony providers offering Pay As You Go phones

All items purchased using Sniping tools are not eligible for Nectar points since these tools are not compatible with ebay.co.uk. If you use these tools to win an auction, the transaction will be completed on ebay.com and because of that you are not entitled to receive Nectar points.

In addition, eBay reserves the right to exclude other items, categories or sellers as may be necessary to comply with the law or its contractual obligations. Please look out for the Nectar logo on the view item page to confirm that your purchase will give you Nectar points. Please note: the Nectar logo will NOT be visible on view item page on the mobile web.

2. Converting Nectar points into eBay vouchers

To convert Nectar points into eBay vouchers (“vouchers”):

• you need to have linked your eBay and Nectar accounts for collecting points;
• you need to log into Nectar online account and authorise eBay to set up your account for spending points; and
• you need at least 500 points to redeem your points for a voucher. Vouchers are issued in increments of 500 points up to 40,000 points (max £200 per voucher).

In case of lost or stolen cards, or if you don’t visit the Nectar section in My eBay more than once every 12 months, you will need to link your eBay and Nectar accounts and follow the process detailed above again to allow you to spend your points.

2.1 Using your eBay voucher

A minimum £10 total purchase price is required (including the cost of postage & packaging) to be able to apply (use or redeem) your vouchers on eBay.co.uk. You can use your vouchers to make a purchase across all of eBay.co.uk.

Vouchers cannot be converted back into Nectar points, and cannot be cancelled once they are issued.

You can use more than one voucher at checkout.

You can only convert Nectar points into vouchers on desktop.

The vouchers cannot be used to purchase items from the following categories:

1. Cars, Motorcycles and Vehicles (Parts and accessories are NOT excluded)
2. Holidays & Travel
3. Property
4. Gift Vouchers, Coupons, Coins & Bullion
5. Baby Feeding: Formula

The vouchers cannot be used to purchase items from the following sellers:

1. Tesco outlet
2. Co-operative Electrical
3. Telephony providers offering Pay As You Go phones

2.2 Refunds:

• If you return a purchase for a full refund, we will re-issue the voucher(s) which has been used for this purchase;
• The voucher expiry date will be extended by 30 days if the original voucher expiration date is less than 30 days from the date the return is processed. Otherwise, the expiry date will be the same date that was displayed on the original voucher(s);
• In the case of a partial refund, voucher(s) cannot be re-issued and points will not be returned.
   

2.3 Expiry date

Please note that vouchers will expire one year after the date they were issued. You can view the expiry date of all your vouchers by viewing the Nectar section in My eBay.

3. eBay rights and liabilities

eBay reserves the right to withdraw at any time any Nectar points or eBay vouchers that were granted:

• not in accordance with these terms and conditions;
• in the case of any fraudulent activity;
• in error – for instance if the Nectar logo was mistakenly displayed on the view item page of an excluded item; or
• in cases where the purchase price was refunded for any reason;

eBay reserves the right any time to:

• withhold or delay issuing Nectar points or eBay vouchers; and
• change these terms at any time.

eBay reserves the right to withdraw offering you the opportunity to convert Nectar points into eBay vouchers upon 30 days’ notice. In the event that eBay withdraws this feature, any Nectar points that have already been converted into eBay vouchers shall remain valid until their expiry date.

eBay shall not be liable, in contract or tort (including negligence) or breach of statutory duty or in any other way, for any loss or damage howsoever arising suffered by the use of Nectar on eBay. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.

4. General

You cannot collect or spend Nectar points on eBay.co.uk when using Guest checkout.

Promotion period

This promotion ("Promotion") will be open from the start date as stated on the banner/email/other communication that you saw/received regarding this Promotion ("Marketing Materials") or, if no such date is stated, then from when you first saw the Marketing Materials until the end date as stated on the Marketing Materials ("end date"). This period will be known as the "Promotion Period".

Alternatively, the Promotion Period may be limited to the number of times the Promotion offer can be used. If this is the case, it will be clearly stated in the Marketing Materials.

Eligibility

Please find below the requirements for eligibility for bonus offers

1. When you purchase an item: You must be registered on www.eBay.co.uk (the "Site") and have a Nectar card linked to your Site account.
2. When you link your Nectar and Site accounts: You must be registered on the Site and have no existing Nectar account linked to your Site account. To receive the bonus offer you must either link your Nectar account number to your Site account or sign up for a Nectar account on the Site. The bonus offer applies once only the first time you either link your Nectar account number to your Site account or sign up for a Nectar account on the Site. A maximum of 100 bonus points may be claimed by each person. Relinked accounts or multiple applications will not qualify.

Promotion details

The bonus Nectar points that you receive will vary from promotion to promotion. As an example only, the promotion offer could be '100 bonus Nectar points' or 'triple Nectar points'.

Bonus points will be awarded either when an eligible item is purchased, or when no purchase is required, within 28 days. To see how many bonus points you will receive for the specific item(s) you wish to purchase, please click the 'See details' link on the page where the item is displayed, underneath the box where the item price is displayed.

Alternatively, your bonus points will be displayed in My eBay – Nectar page within 28 days.

The bonus points displayed should not be assumed to apply to any other item or to anyone else. Please always refer to the page where the item is displayed to see how many points you will receive for your purchase. This amount includes any points gained as a result of this Promotion. Other people may receive the same Promotion.

There is no cash alternative and the offer is not transferable.

Promotion restrictions

There may be restrictions around eligible categories, minimum spend required (basis of minimum spend will be calculated according to the “Collecting Nectar Points” section of the Nectar programme T&Cs) above and/or listing type (auction style, fixed price etc.). The Promotion may also be restricted to particular sellers. Any of these or any other restrictions will be stated in the Marketing Materials.

Interaction with other promotions and offers

If you are eligible for multiple Nectar related promotions that have been communicated to you by eBay, then you will automatically gain the benefit of the most valuable one, as determined by eBay.

If you are eligible for any Nectar related promotions that Aimia/Nectar communicated to you, then please refer to any applicable terms and conditions to those promotions for details. You may be able to take advantage of this Promotion as well as any promotion that Aimia/Nectar communicated to you and benefit twice. Please note that the amount of points displayed on the page where the item is shown only takes into account promotions communicated to you by eBay.

Exclusion from participation

Any attempt to manipulate the Promotion is prohibited and will result in exclusion from participation.

If eBay has suspicions or knowledge that you have been involved in any actual or attempted fraudulent or illegal activity, eBay reserves the right to disqualify you and anyone else involved in such activity. eBay may also disqualify you if you do not act in accordance with these Terms and Conditions, eBay's User Agreement, the Nectar Programme Terms and Conditions, and/or any policies that eBay may communicate to you.

If your Nectar card is/becomes blocked, closed or restricted for any reason during the Promotion Period, you are/will be excluded from participating in the Promotion.

Limitation of liability

eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any Promotion.

eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by you resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.

eBay will not be responsible for any third party's performance or failure to perform any services related to any Promotion, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.

eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds you of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion.

Although eBay will use reasonable efforts to ensure that all information relating to the Promotion ("Promotion Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion or the site, including without limitation the accuracy of any Promotion Material.

General

eBay reserves the right to suspend, change or cancel this Promotion at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this Promotion. This includes the ability to substitute the offer, which is, in eBay's reasonable opinion, of equivalent value or change the specification of the offer if circumstances require it.

eBay reserves the right to verify your eligibility for this Promotion.

eBay may use third parties to facilitate one or more elements of the Promotion. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation. These Terms and Conditions are governed by the law of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under these terms and conditions.
